In the world of recruiting there is a simple obstacle that can have major effects on a company at a later point in time. This obstacle is never really knowing the candidate you are attempting to recruit. You may have their entire work history and education sitting in an email on your computer, but is that everything? Even when someone is in the middle of their best lie, their body language could be telling a different story. Research done by Dr. Lillian Glass, a behavioral analyst who has worked with FBI in finding better ways to detect deception put forth by criminal suspects, has released a few tips for catching a candidate in the middle of a lie. Of course these are not undeniable evidence, as every person has their own mannerisms. If you believe a candidate is lying to you though, these signs may help you decide for sure.

1. Shuffling Feet

At the top of the list is the fidgeting motions of an candidate during an interview. Especially when it comes to shuffling feet. This is a very clear sign of discomfort or nervousness. This nervousness could be merely from the interview itself, or from them hoping a mistruth slips by unnoticed.

2. Sudden Head Shifting

Some find it difficult to tell a lie to the face of another. The human conscience is a hard barrier to bypass. When a candidate is asked a question they don’t plan on being honest with, their head may display a shift to the side or bowed down, sudden jerk, or become tilted.

3. Hand Covering the Mouth

When a liar wants to end a topic matter they may raise their hand to or over their mouth. They may become less active in the conversation as well. This could very well mean they have reached the end of the story they were trying to sell you and want to move on before you become any wiser to their plans.

4. Heavy Breathing

When lying, a person’s body can experience internal changes as well as external. Their heart rate and blood flow can change, which can lead to heavy breathing. As there are few real apparent reason for a person to be out of breath, especially in an air conditioned office during an interview, pay close attention to the details of their story.

5. Covering Up Vulnerable Body Parts

Dr. Glass has witnessed in court that when asked a certain question, some people would cover the front of their throat. Almost in a defensive manner. Other areas that have been covered during such an event is the head and chest area.

6. Constant Blinking

It is an age old saying, “look me in the eye and say it”. Apparently it may just hold truth behind it. One behavior of someone in the midst of a lie well making eye contact is to blink constantly. Almost like they wish to look away but can’t.

7. Excessive Pointing

Liar’s can sometimes tend to get defensive and attempt to act confident in a way that comes out as hostile. This can involved pointing and a change in tone.

Though they can help detect a lying candidate, do keep in mind that they could also be signs of simply being nervous. The seven items listed can’t be used alone, but have to be paired with observation and the instinct of the interviewer.

The business world is a limitless field of potential employment and advancement. With so many opportunities presented to us, some complications and confusion can naturally occur. Another question that may not get asked as often is the question of rather or not either you or someone else should be classified as an employee or an independent contractor.

By now everyone should know what an employee is. Someone trading time and labor for financial benefit with a company. If you live in the Lake Mary area in central eastern Florida you can enter one of the city’s grocery stores and see employees performing all kinds of tasks. They stock shelves, run the registers, sweep the floors, and welcome the customers. But who fixes the plumbing and electrical? Who creates the flyers and advertisements? Who does work for the company not related to the service they are providing? They may hire another company for this, or they may use an independent contractor.

Employee vs Independent Contractor:

From the outside, both classifications can seem very similar. When you work as one or the other, the differences can become much more apparent. An employee works closer to the company, and is considered a part of the company itself. The company will withhold federal income tax and the employee’s portion of the Social Security and Medicare taxes. They also are required to pay for other things such as Workers’ Compensation and state unemployment taxes. Employees make up the greater part of the work force.

When dealing with an independent contractor, they will typically perform duties farther away from the companies core services. The employer does not have a responsibility to withhold any taxes from their paycheck and simply have to report how much the independent contractor was paid by the company. The independent contractor will have to pay his own taxes for the pay received from the work performed.

Seven Ways to Decide Worker Classification:

Amount of Control: The amount of control and supervision given can help decide how to classify an employee. If the employer has a large amount of control, or spends more time in a state of supervising the worker then it is most likely an employed arrangement. An employee will usually represent a company more than an independent contractor, and cost more in taxes. They have a schedule they must follow for when they work and don’t work. The company can tend to expect more from them because of this.

Independent contractors on the other hand will carry the company name with them, but are in most cases less representative of the company and more representative of themselves. Their work may not be at the company but done at home or in their own office, or at the businesses’ of clients to the company. They are still supervised as all paid employment is, but are more free to set their own schedules.

Paying for Equipment: An employee will use the equipment of the company he works for. The computers, office supplies, cash registers, company vehicles and other common equipment is provided by the company. Unless an employee directly damages an item, he pays no out of pocket expense for new equipment.

An independent contractor is expected to have the tools required to complete an assignment. If their equipment is damaged, they are expected to replace it at their own expense. Some companies may supply certain equipment to a contractor, but for the most part it is on the shoulders of the independent contractor.

Potential for Profit or Loss: An employee is not at risk of unprovoked profit loss. They are paid a fixed amount for every hour or day of work. The only expenses they have to worry about as far as the workplace is concerned is the cost of commuting to work and home. A lost in profit or pay will, for the most part, only occur when the employee causes negative consequences against their self from a violation or lack of production.

Independent contractors on the other hand can suffer profit or loss depending on the work given. Working on commission can cost more than profit if the work week is slow. If no work is available on a certain day than no income can be collected for that day.

Job Security: An employee can typically be removed from employment easier than an independent contractor. An independent contractor has the equipment and knowledge that would have to be replaced. They may also be on a contract for a certain time period to work for the employer. An employee uses the equipment of the company, and typically only the labor performed has to be replaced.

Relation to the Company’s Services: Employees work close to the core services provided by a company. If one of the grocery stores in Lake Mary hires someone to stock shelves and run registers, they are considered an employee performing the basic duties of the store. If this same store has an individual create flyers and marketing to attract customers, this person is not performing retail services, and is considered an independent contractor.

Employer and Worker Relationship: An employee and the employer will have a stronger connection, working together for the same goal and company. Their work can be potentially permanent as long as the company remains in business. An independent contractor may be hired for a certain amount of time or until an assignment is complete.

Work Relationship Created During Hiring: Rather an new worker is classified as an employee or an independent contractor can be determined during the first interview, or the first day of employment. Both the employer and the worker can agree on the terms of the employment. Sometimes it will be stated during the recruiting process rather a position classifies as for an employee or an independent contractor.

When an employee’s performance is deteriorating, avoid getting personal. But what can a supervisor do about a poor-performing employee while staying in compliance with federal and state laws? Do Not Get Personal with Employees.

Q. During the last three or four months, an employee’s work performance and productivity has steadily deteriorated. In the past, this individual’s performance was good. The employee has lost weight, is frequently late for work and very often will leave work during some part of the workday. I don’t know if the problem is physical, mental, marital, financial or maybe drug or alcohol related. We have an Employee Assistance Program (EAP) in place, but can I recommend this employee use it or otherwise seek help? How should I approach this?

A. When an employee’s quality of work plunges, supervisors and employers want answers — and rightfully so. They want to know why the individual is no longer putting out the quantity or quality of work he or she used to.

If finding the answer to this problem means probing into the employee’s personal and private life, is this a wise avenue to pursue?

As an employer, you have some responsibilities and obligations. You have the responsibility to your business to resolve this problem. You have a responsibility to hire and keep good employees who contribute to your company’s success.

Stressed-out employees may even become a safety threat, to themselves, to co-workers and even a liability to the business.

You have obligations and restrictions under laws which limit your actions. If the employee is older, you must be concerned about age discrimination. If the employee is seriously ill, the Americans with Disabilities Act may protect him or her. Inquiring about an employee’s personal life may infringe on privacy rights.

If you act on the assumption the employee is under the influence of drugs or alcohol, you run the risk of being wrong and facing a defamation lawsuit.

It’s not surprising employers take the view that a “cure” may be more dangerous than enduring the problem.

Consider this approach:

Address the crux of your complaint, which is poor performance. Visit with the employee about the change in his or her performance, and the recurring tardiness and absenteeism. Ask if he or she knows the reason for this change of behavior. Show your concern and encourage the use of your EAP program.

Be kind, but firm. Tell the employee he or she must make changes which will result in satisfactory performance. Set a reasonable length of time to see improvement and expect improvement to continue, or you may need to terminate this person’s employment. This confrontation may cause the employee to open up, in which case you can then offer accommodation or treatment. (Employers may require psychiatric and physical examinations to assess an employee’s fitness to do a job.

A company picnic is a great way to bring employees together with their managers, and provide a sense of community in the work place. Have employees bring their own dishes to cut back on cost, and use a public location to avoid the costly expense of renting room or space from another company for a day. Include some fun games for employee’s children, such as a race, or maybe even a friendly softball game. Morale is an important part of employee management. The entire group benefits, and with these simple ideas, everyone from the office worker to payroll and even the business owner will enjoy their summertime both in and out of the work place.
